Access to the restored land for the landowners in agreement with the relevant Management Authorities and in accordance with the Protected Areas Act and the Settlement Agreement.

BBBEE

Broad Based Black Economic Empowerment Act, 2003 (Act No. 53 of 2003). BBBEE aims to broaden the economic base of the country, to stimulate further economic growth and to create employment. The focus is on empowering the historically disadvantaged, particularly black people, women, youth, disabled and rural people.

Benefits beyond boundaries

This is one of the major themes of the People and Parks Programmes. It promotes the creation of enabling environments that allow communities to benefit from the protected area, even if they do not utilise the natural resources within the parks themselves.

Beneficiation

The claimants gain direct and indirect benefits from the activities conducted and operated from the protected areas.

Best practice

The use of a particular instance as an example of general principles that can inform the direction of future activities within a project framework. Valuable lessons can be learnt from this situational analysis and can therefore provide guidelines as to how to influence a situation to get the required outcome.

Biodiversity

Biodiversity is the term used to describe the existence of a wide variety of species in a particular area or during a specific period of time. The variety of life on Earth. “Bio” means life and “diversity” means difference.

Bioregion

A bioregion is a land area that shares similar plant and animal species, water, climate, rocks, soils, landforms [topography] and human culture.

Cabinet memorandum   

Is a notification in which government states it’s recommended position and methodology on any governmental issue.

Claimant   

Anybody who was dispossessed of their land after 19th June 1913 under racist legislation has been given the right to claim restitution against the State. Once they have lodged a claim, they are known as the “claimant”.

Co-management   

In accordance with S42 of NEM:PAA, co-management refers to a mutual beneficial situation between/amongst collaborators without the duplication of management functions. However, the management authority remains responsible and accountable for the management of the protected area.

Co-management Committee   

The committee established between the management authority and claimants, and possible other parties for the purposes of the co-management of the restored land.

Commercial revenue   

The revenue generated from Economic Activities and Commercial Activities, including game sales, concession fees, and rent paid to the Management Authority, less the Management Authority’s reasonable costs for the administration of such gross revenue and excluding government grants and MTEF budget allocations, infrastructure funding, international and local aid/donor funding, donations and poverty relief or similar funding unless specific provision is made to the contrary.

Contractual Park Agreement Working Group

A working group that specifically deals with the contractual agreements.

Economic activities   

Commercial and related community activities that are capable of being conducted on the Land in accordance with the management plan and provided for in terms of section 50 of the NEM:PAA.

Economic tourism

Marketing initiatives to make the most of individuals who travel to another country or place that is not their home. For foreign tourists this involves visitors who stay at least one night and less than one year in collective or private accommodation in the country. This includes students but excludes workers and contract workers. In the domestic market, a tourist is a resident of South Africa who spends the night away from their usual environment and also less than one year. This excludes day visitors and people who get paid in the place they visit.

Institutional structures that serve to make decisions and control administrative and executive functions within and amongst organisations.

Land claims   

The restitution claims lodged with the Commission in terms of the Restitution Act , 1994 (Act No. 22 of 1994) and which are in Protected Areas.

Land restitution   

The act of restoring to the rightful owner, land that has been taken away, lost or surrendered. It may also be defined as the act of making good or compensating for the land which was lost. Restitution is actually about redistributing the land to rightful owners whereas reform and conservation are about developing that land to the benefit of all.

Management authority   

An organisation that exercises final authority over the functioning and management of a protected area.

Management plan   

A plan that outlines the ways and means of achieving the objectives of the organisation/project or programme. It takes into consideration the best means of achieving the objectives using resources available.

New landowners    

Owners of the land restored through the Restitution Act, 1994 (Act No. 22 of 1994).

Parties   

Management authorities, claimants and other appropriate parties.

Policy   

A definite method of action to guide and determine present and future decisions. It is usually a set of rational decisions and a common long term purpose. Government policies are mostly supported by special legislation.

Existing management authority   

The organ of state appointed by the Minister of Water and Environmental Affairs in terms of the applicable legislation to manage the protected area.

Restitution settlements   

The resolution of land claims.

Restored land   

Land owned by the new landowners, as restored in terms of the Restitution of Land Rights Act, 1994 (Act No. 22 of 1994).

Settlement agreement

The agreement between the Minister of Rural Development and Land Reform, and the Claimant and other relevant stakeholders. It refers to the settlement of particular land claims in a protected area.

Strategy

A plan of action designed to achieve a specific outcome through short or long term operations.

Trust

The trustees of the specific Community Trust, for the time being. They are duly lodged with the Master of the High Court in line with the terms of the Trust Property Control Act, 1988 (Act No. 57 of 1988). They act under Letters of Authority.
