Publication of the notice on the amendment to the Regulations Laying Down the Procedure to be Followed for the Adoption of Spatial Tools or Environmental Management Instruments

The notice has been published on the amendments to the Regulations Laying Down the Procedure to be Followed for the Adoption of Spatial Tools or Environmental Management Instruments (the Adoption Regulations), as published in the Government Gazette No. 42380 of 5 April 2019.
The amendment was published by the Minister of Forestry, Fisheries and the Environment, Ms Barbara Creecy, in the Government Gazette Notice No.50289 of 14 March 2024. It makes provision for the process of adoption of environmental management instruments contemplated in section 24(2)(c) and (e) of the National Environmental Management Act, 1998, Act and to provide for registration requirements, where deemed appropriate, for the exclusion of activities based on the adoption of an environmental management instrument in terms of these regulations.
The term "spatial environmental instrument" has been removed in favour of the term environmental management instruments, whilst the "spatial tools" has been removed throughout the regulations. Further, the amendment allows for the adoption of an environmental management instrument and to exempt an activity from the need to obtain an environmental authorisation as one action; and a provision to allow for a registration process for projects which have been exempted under the regulations has been included.
